Three things that determine your dismissal protection.
- 3-week deadline: After the termination reaches you, you have only 3 weeks to file an unfair-dismissal claim (Kündigungsschutzklage). After that it usually becomes effective.
- When you are protected: In companies with more than 10 employees, the Protection Against Dismissal Act applies after 6 months. Then every termination needs a valid reason.
- A claim rarely means court: Most dismissal-protection proceedings end in a settlement: you leave, but with a negotiated severance payment.
